Acceptance of Terms
These Terms of Service (“Terms”) govern your use of the McNeil Custom Stone website located at www.mcneilcustomstone.com (the “Site”) and any services provided by McNeil Custom Stone (“Company,” “we,” “us,” or “our”).
By accessing or using our Site, submitting an estimate request, entering into a service agreement, or engaging our services in any capacity, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. These Terms should be read in conjunction with our Privacy Policy.
Description of Services
McNeil Custom Stone is a family-owned, veteran-operated business with over 35 years of experience specializing in the fabrication and installation of natural stone and engineered stone countertops. We serve both residential and commercial clients throughout Arizona.
Our services include, but are not limited to:
- Countertop Consultation: Free initial consultation to help customers select the appropriate material, edge profile, thickness, and design for their project.
- Custom Fabrication: Precision cutting, shaping, and finishing of granite, quartz, marble, quartzite, and other natural or engineered stone materials. Includes fabrication of thresholds, window sills, shower curbs, and other custom stone pieces.
- Professional Installation: Expert installation of fabricated countertops and stone products in residential and commercial settings.
- Repair Services: Repair of chips, cracks, and damage to existing stone countertops; resealing of porous stone surfaces.
- Maintenance Services: Ongoing maintenance to preserve the appearance and longevity of stone countertops.
Services are subject to availability. We reserve the right to decline any project at our discretion.
Estimates & Quotes
Free Estimates
We offer free estimates for countertop fabrication and installation projects. Estimate requests submitted through our website will receive a response within approximately 2 business days.
Nature of Estimates
All initial estimates are based on the information provided at the time of inquiry and are subject to change. A final binding quote will only be issued after an on-site measurement and assessment (if applicable), final material selection and confirmation, and review of the full project scope.
Estimate Validity
Written quotes are valid for 30 days from the date of issuance unless otherwise stated. Material pricing is subject to market fluctuations and supplier availability. We will notify you of any pricing changes before work begins.
No Obligation
Submitting an estimate request through our Site does not obligate you to proceed with our services, nor does it obligate us to perform services until a formal agreement is signed and a deposit is received.
Project Agreement & Scheduling
A project is confirmed only when a written project agreement has been signed by both parties and the required deposit has been received. Project scheduling is conducted on a first-come, first-served basis.
While we make every effort to adhere to the agreed schedule, timelines may be affected by material availability and lead times, site readiness, weather or unforeseen conditions, and scope changes requested by the customer. We will communicate any significant schedule changes to you as soon as reasonably possible.
Site Readiness
It is the customer's responsibility to ensure that the installation site is ready on the agreed installation date. Delays caused by incomplete cabinetry, ongoing construction, or inaccessible areas may result in rescheduling fees.
Payment Terms
Deposit
A deposit is required to secure your project on our schedule. The deposit amount will be specified in your project agreement. Deposits are generally non-refundable once materials have been ordered or fabrication has begun, except as otherwise stated in your project agreement.
Balance Due
The remaining project balance is due upon completion of installation, unless alternate terms are specified in writing.
Late Payments
Invoices not paid within the agreed timeframe may be subject to a late payment fee of 1.5% per month (18% annually) on the outstanding balance.
Returned Payments
Returned checks or failed electronic payments will incur a returned payment fee of $35.00, in addition to any applicable bank charges.
Site Conditions & Customer Responsibilities
To ensure a successful project, the customer agrees to:
- Provide accurate measurements and project information at the time of the estimate request
- Ensure that cabinetry, base structures, and support systems are level, properly secured, and capable of supporting the weight of stone countertops prior to the installation date
- Clear the work area of personal belongings, appliances, and obstructions before our team arrives
- Provide reasonable access to the property, including parking and entry to the work area
- Ensure that a responsible adult (18 years or older) is present during the entire installation
- Disclose any known hazards, accessibility issues, or unusual conditions at the property
McNeil Custom Stone is not responsible for damage caused by pre-existing structural deficiencies or site conditions that were not disclosed prior to the commencement of work. Any plumbing, electrical, or other trade work required in connection with a countertop installation is the responsibility of the customer unless otherwise specified in the project agreement.
Materials & Product Selection
Natural Stone Variations
Natural stone products — including granite, marble, quartzite, and similar materials — exhibit natural variations in color, pattern, veining, and texture. These variations are inherent characteristics of natural stone and are not considered defects. Customers acknowledge that the finished product may vary from samples, photos, or displays viewed during the selection process.
Material Availability
Material availability is subject to supplier stock and may change between the time of estimate and project execution. If a selected material becomes unavailable, we will work with you to identify a suitable alternative. Additional costs, if any, resulting from material substitutions will be communicated and agreed upon in writing before proceeding.
Material Responsibility
Once materials have been cut and fabricated to your specifications, they cannot be returned or exchanged. The customer is responsible for ensuring that material selections are finalized before fabrication begins.
Customer-Supplied Materials
If a customer supplies their own materials for fabrication, McNeil Custom Stone assumes no liability for defects, breakage, or damage inherent in the customer-supplied material. Additional fees may apply.
Fabrication & Installation
Precision Fabrication
All countertops are fabricated to precise measurements taken on-site or provided by the customer. Customers are responsible for the accuracy of any measurements they provide.
Seams
Due to the nature of stone fabrication and the physical dimensions of stone slabs, seams may be required for larger countertop runs. Customers acknowledge that seams are a normal part of stone countertop installation and do not constitute a defect.
Inspection at Completion
Upon completion of installation, the customer is encouraged to inspect the work with our installer before the team departs. Signing off on the completed installation or making final payment is considered acceptance of the work as completed.
Warranty & Workmanship Guarantee
Workmanship Warranty
McNeil Custom Stone warrants that all fabrication and installation work will be performed in a professional and workmanlike manner. We stand behind our craftsmanship and will address any defects directly attributable to our workmanship.
Manufacturer Warranties
Engineered stone products (such as quartz) may be covered by the manufacturer's warranty. We will provide applicable manufacturer warranty documentation at the time of project completion.
Warranty Exclusions
Our warranty does not cover:
- Normal wear and tear
- Damage caused by improper use, misuse, or failure to follow maintenance guidelines
- Damage caused by impact, excessive weight, thermal shock, or chemical exposure
- Natural variations in stone color, pattern, or veining
- Settling or structural changes in the property after installation
- Damage resulting from plumbing leaks or other trade-related issues
- Work performed or alterations made by parties other than McNeil Custom Stone
Limitations of Liability
To the maximum extent permitted by applicable law:
- McNeil Custom Stone's total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim.
- McNeil Custom Stone shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits or loss of use, even if we have been advised of the possibility of such damages.
- We are not liable for delays caused by circumstances beyond our reasonable control, including supplier delays, natural disasters, labor disputes, or governmental actions.
Cancellation & Changes
Customer Cancellation
You may cancel a project by providing written notice. The following conditions apply:
- Before materials are ordered: Deposits may be refunded in full at our discretion.
- After materials are ordered but before fabrication begins: A restocking or material cancellation fee may apply, up to the full cost of ordered materials.
- After fabrication has begun: The deposit is non-refundable, and you may be responsible for the cost of materials and fabrication work completed to date.
Scope Changes
Changes to project scope after a signed agreement may result in additional costs and scheduling adjustments. All scope changes must be approved in writing by both parties before work proceeds.
Company Cancellation
We reserve the right to cancel a project if site conditions are found to be unsafe, if payment obligations are not met, or if other circumstances arise that make completion impractical. In such cases, you will be refunded any amounts paid less any non-recoverable costs incurred.
Website Use
You may use our Site for lawful purposes only. You agree not to submit false or fraudulent information, attempt unauthorized access to the Site, use automated bots or scrapers without our written consent, or transmit any malicious code through the Site.
We strive to keep the information on our Site accurate and up to date; however, pricing, availability, and service descriptions are subject to change without notice. The Site is provided for informational and estimate-request purposes only.
Intellectual Property
All content on the McNeil Custom Stone website — including text, photographs, graphics, logos, videos, and overall design — is the property of McNeil Custom Stone or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, or use any content from our Site for commercial purposes without our prior written permission. You may print or download pages from the Site for your personal, non-commercial use only.
Dispute Resolution
Informal Resolution
We encourage you to contact us directly first. We will work in good faith to reach a mutually satisfactory resolution within a reasonable timeframe.
Mediation
If a dispute cannot be resolved informally, the parties agree to attempt resolution through non-binding mediation before pursuing litigation. Mediation shall be conducted in Arizona by a mutually agreed-upon mediator, with each party bearing its own costs.
Arbitration
If mediation is unsuccessful, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA) in Arizona. The arbitrator's decision shall be final and binding.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Arizona.
Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site, and the “Last Updated” date will be revised accordingly. Your continued use of our Site or services after any changes are posted constitutes your acceptance of the revised Terms.
